			<content:encoded><![CDATA[<p>A woman from Greater Manchester has been awarded £3.75 million in compensation, after being left brain damaged following a collision with a car.</p>
<p>Fifty year old Fatemeh Panahzadeh was crossing Ladybridge Road, close to her home in Cheadle Hulme, when she was struck by the vehicle.</p>
<p>The Manchester Evening News is reporting that Fatemeh was hospitalised for over a year after suffering a serious brain injury and had to undergo surgery, in which part of her skull was removed so that surgeons could release a blood clot on her brain.</p>
<p>The accident had life changing consequences for Fatemeh, who now relies on a wheelchair for mobility as she is not able to walk, her speech has also been affected and her brain is now unable to process and understand information as it once did.</p>
<p>Her husband sixty two year old Faramarz Vossough, who had to give up his job to be a full time carer for his wife, launched a claim for road traffic accident compensation on his wife’s behalf against the car drivers insurers.</p>
<p>Following a long drawn out legal battle the family has now been awarded £3.7 million in compensation, which will help to pay for the round the clock care Fatemeh will require for the rest of her life.</p>
<p>The driver of the car involved was cleared of a charge of driving without due care and attention, following a court case in January 2011.</p>

			<content:encoded><![CDATA[<p>A motorcyclist from East Sussex, who suffered serious personal injury after being involved in a collision with a car, has been awarded £22,500 in road traffic accident compensation.</p>
<p>The Sussex Courier is reporting that Owain Sullivan, from Nutley, was travelling along the busy A22 close to Horney Corner, when a Peugeot 206 in front made a left turn into a side road, inexplicably and without warning the driver then performed a U-turn to get back onto the A22 and drove straight into the path of Mr. Sullivan’s approaching 250cc motorbike.</p>
<p>Mr. Sullivan, who is training to be a mechanic, was catapulted through the air by the force of the impact and had to be airlifted to hospital suffering with damage to his spine, neck and groin, as well as a fractured wrist and numerous cuts and bruises.</p>
<p>He told the newspaper that there was no way he could have avoided the collision, as it all happened in a split second but considered himself fortunate that his injuries were not more severe.</p>
<p>Mr. Sullivan pursued a claim for road traffic accident compensation against the car driver’s insurers and has now been awarded £22,500 in damages.</p>

			<content:encoded><![CDATA[<p>A window manufacturing company based in Cheshire, has been prosecuted and fined after an employee had a finger severed by a poorly guarded rotating saw.</p>
<p>The twenty six year old, who has not been named, was working for East Cheshire Glass Ltd, at their plant on London Road, in Macclesfield and was attempting to position a piece of uPVC plastic under the saws rotating blade, ready for cutting.</p>
<p>Unfortunately the blade came into contact with his left hand and severed his index finger at the second knuckle.</p>
<p>Macclesfield Magistrates&#8217; Court was told that the machine was left running in-between cuts to help speed up production, it was also noted that the blades safety guard had been adjusted in such a way, that several inches of the blade were left uncovered.</p>
<p>East Cheshire Glass Ltd pleaded guilty to breaching the Provision and Use of Work Equipment Regulations and was consequently fined £1,000 for allowing access to dangerous moving machine parts.</p>
<p>A spokesperson from the Health and Safety Executive stated that this type of accident was still commonplace in the manufacturing industry and added that suitable guarding of dangerous machinery was vital, in order to safeguard employees.</p>

			<content:encoded><![CDATA[<p>An ex-RAF serviceman, who broke his neck after he went head first into a shallow inflatable pool, has won his claim for compensation.</p>
<p>Robert Uren, from Camborne, in Cornwall, was just twenty one years old at the time of the accident, which happened when he was taking part in a Fun Day event organised by the Ministry of Defence, which took place in Buckinghamshire in 2005.</p>
<p>Mr. Uren was competing in a services personnel relay event, which involved participants retrieving pieces of plastic fruit from an inflatable pool, the former RAF man however went head first into the pool during his turn, fracturing his spine in three places and leaving him paralysed.</p>
<p>After being medically discharged from the RAF, Mr. Uren launched a claim for six million pounds in compensation against the M.O.D and Corporate Leisure (UK) Ltd, who supplied equipment for the event.</p>
<p>The claim was originally dismissed by a judge at the High Court, who ruled that there had been no breach of duty of care, as the game had been reasonably safe.</p>
<p>However this ruling was overturned by the Court of appeal and following a retrial Mr. Uren won his claim for compensation, the actual amount of compensation he will receive will be decided at a later date.</p>

			<content:encoded><![CDATA[<p>A cancer patient, who had the wrong testicle removed during surgery, is to launch a claim for medical negligence compensation.</p>
<p>The forty eight year old, who has not been named, was admitted to the Salisbury District Hospital, to have a cancerous testicle removed.</p>
<p>However just forty minutes after the procedure was carried out, a doctor realised that the man’s healthy testicle had been removed by mistake.</p>
<p>The man, believed to be from the Wiltshire area had to endure remedial surgery, to try and rectify the error but it appears that he will no longer be able to father children.</p>
<p>He has now launched a claim for medical negligence compensation against the Salisbury NHS Foundation Trust, who manages the hospital, claiming that hospital staff had been negligent.</p>
<p>A spokesperson from the Salisbury NHS Foundation Trust, confirmed that legal action was pending and apologised for what they called a ‘regrettable incident’.</p>
<p>Just a few days ago it was being reported that the National Health Service Litigation Authority, who compensate victims of NHS errors, had paid out over £1 million in compensation to fifty six patients, who had had the wrong testicle removed during operations carried out over the last four year period.</p>

			<content:encoded><![CDATA[<p>A Lincolnshire mother of three who had to have part of her leg amputated, after going into hospital for routine surgery to remove varicose veins, has been awarded a six figure interim compensation payment.</p>
<p>Forty six year old Lorraine Brewin, from Grantham, was admitted to the Grantham Hospital for routine surgery to remove varicose veins from her left leg and expected to leave the hospital the next day. However due to a dangerous build up of blood in her leg, known as ‘compartment syndrome’, she had to be transferred to the Lincoln County Hospital for further surgery.</p>
<p>Eventually, following critical delays and a lack of adequate physiotherapy, Mrs. Brewin had to have the lower part of her leg amputated.</p>
<p>She launched a claim for medical negligence compensation, against the United Lincolnshire Hospitals NHS Trust, who manage the hospitals and has now been awarded a six figure interim compensation payment, which will allow her to move into a bungalow, which has been especially adapted to her needs.</p>
<p>The United Lincolnshire Hospitals NHS Trust admitted that the amputation could have been avoided, had Mrs. Brewin received an adequate standard of care following her operation.</p>

<p>Forty nine year old Robert Wilson, from Whitehill, near Bordon, was with his scout troop at the Clyne Farm Centre, near Swansea, where they were attempting the Challenge Valley assault course.</p>
<p>When they reached the ‘Burma Bridge’ obstacle, Mr. Wilson was required to slide down a ten foot high fireman’s pole; despite having reservations about the descent, he was reassured by an instructor and began to slide down the pole.</p>
<p>Unfortunately the scout leader careered down the pole too quickly and landed on his bottom at the base of the obstacle, fracturing a vertebra in his spine.</p>
<p>He was airlifted to hospital by helicopter, where he underwent major surgery for his injuries, which has affected his ability to look after his disabled wife and continue his work as a taxi driver.</p>
<p>Mr. Wilson launched a claim for personal injury compensation against the Clyne Farm Centre, claiming that he had not received proper instruction on how to descend the pole safely in the wet conditions.</p>
<p>He was awarded £170,000 in damages, following a High Court hearing, to cover his loss of earnings and for the pain and suffering caused by his accident.</p>

			<content:encoded><![CDATA[<p>A female employee working at a juice bar in the Meadowhall shopping centre has been awarded compensation, after suffering an electric shock from a faulty freezer.</p>
<p>Thirty four year old Julie Humphries, from Rotherham, in South Yorkshire, was working for the Boost Juice Bar, inside the shopping centre near to Sheffield and suffered the electric shock when she placed her hand on top of the freezer, as she collected produce.</p>
<p>Mrs Humphries was off work for seven days following the accident, suffering with pains in her neck and shoulders, as well as excruciating headaches.</p>
<p>The Star newspaper is reporting that an investigation into the incident revealed that the branch manager was aware of the fault but had failed to inform staff of the hazard, or take any action to eliminate the danger, a mistake which led to him losing his job.</p>
<p>Mrs Humphries launched a claim for accident at work compensation against the Boost Juice Bar Ltd and was awarded an undisclosed amount in compensation, after the company admitted liability for the incident and agreed to settle out of court.</p>
<p>A spokesperson from her legal team stated that if regular tests had been carried out on the electrical equipment in the shop, the potential hazard would have been highlighted and the accident completely avoided.</p>

<p>Forty nine year old Sylvia McNicholl was enjoying the first night of her family holiday in Tenerife, when she slipped in a puddle of water that had allegedly leaked from a faulty air conditioning unit.</p>
<p>The slip caused her to fall backwards and as she did so her head came into contact with a cupboard door, rendering her unconscious and in need of stitches to a nasty head wound.</p>
<p>Mrs McNicholl told the Daily Record newspaper that the accident has had a lasting affect on her health and her sense of smell and taste have been impaired because of her head injury.</p>
<p>The family launched a claim for holiday compensation against tour operator Thomas Cook, for the cost of the ruined holiday and for the pain and suffering caused to Mrs McNicholl.</p>
<p>Her legal team reportedly secured evidence that the Fanabe Costa Sur hotel in Tenerife, where the family stayed, did not have proper maintenance records regarding the air conditioning system, which is required by law in Spain.</p>
<p>A settlement of £37,000 was agreed with the tour operator, which will cover the cost of Mrs McNicholl’s future care, as well as contributing to her loss of earnings, as she has not, as yet been able to return to work.</p>

<p>Fifty seven year old Brian Ogden, from Royton, in Greater Manchester, was working for his brothers company Classic Joinery Manufacturers, when he first realised he had an adverse reaction to Iroko hardwood dust.</p>
<p>The Manchester Evening News reports that his first contact with the wood product was over twenty years ago, when he worked on a small number of projects using Iroko wood, he noticed that the dust irritated his eyes, nose and throat and caused him some breathing issues.</p>
<p>When the company won a large order which involved using Iroko timber, Mr. Ogden warned his employers of his allergy and he was given a protective mask containing an air filter.</p>
<p>However he soon developed flu like symptoms and was suffering breathing problems, he was eventually hospitalised, after his condition worsened and he had to be put on a drip due to the severity of his condition.</p>
<p>On his return to work the joiner was given a better mask but his symptoms returned when the battery failed and was never replaced.</p>
<p>Mr. Ogden launched a claim for industrial illness compensation against the company, who went into liquidation and ceased trading in 2009; he was awarded a reported five figure sum in damages.</p>
